that says I working with this buyer as a customer?

Betty's Gravatar Hi Rob. Congratulations on being the first person to ask a question on our
blog. The reason that the statement as to whether the buyer or seller is a
customer was removed from the 2008 contract is because most brokers did not know how to answer the question or used the boxes improperly.
The forms committee felt that since it was often mishandled it would be best
to remove the statement. If the listing broker was a seller's agent and sold
his/her own listing then the buyer would be a customer. If the buyer agent
sold a FSBO and remained an agent to the buyer, then the FSBO would be a
customer. Your disclosure to the buyer or seller would also reflect this.

whether there have been any improvements made not only without a building
permit but also those made with a building permit. This would be a material
fact that a buyer would need to know--so it should cover both. Hope that

Patrick Armbrust's Gravatar In the SELLER PROPERTY DISCLOSURE (SPD) Section A "Structural Conditions" Item #8 asks simply "Any additions or alterations made". This is inclusive of those made with or without a permit as Betty suggested. The next Item #9 goes on and
asks for known "Building code violations". We teach the new licensee to consider researching permit history by calling the local building department. The building department will usually provide the history and let you know if any permits were properly "closed" (Certificate of Occupancy was issued).
